    In the past four decades, there has been significant development of Alternative Dispute Resolutions (ADR) in the USA. These methods have become a regular activity in Federal and State Courts, as well as together with Mediation, Negotiation, Arbitration, and all other derivative forms of resolution now accounting for more than 90% of dispute resolutions in the country. The expanding use of non-judicial methods has played a significant role in the sharp decline in merit awards in American Courts during the late 20th century. Surveys among Fortune 1,000 Corporate Counsel have shown that companies have used Mediation for all types of disputes, and survey respondents overwhelmingly declared its ongoing use by their companies. Besides that, Alternative or Appropriate Dispute Resolutions (ADR) are well-developed in New York City, which is a major financial and commercial center in US. As a result, there is a wide range of institutions, organizations, and professionals offering ADR services in the city. Additionally, there are several institutions dedicated to promoting and administering ADR processes in NYC, including Arbitration, Mediation, and Negotiation.

    Day 3: 05/30 - 09 a.m. to 6 p.m. – Visit to White & Case LLP Law Firm

    Topic 11 - Visit to White & Case Law Firm: We will talk about the Lawyers’ role in the ADR Market in the USA, Areas of Practice, Remuneration, Requirements to become a mediator/arbitrator, career transition for Judges, Lawyers and Public Prossecutor.

    Topic 12 - CPR talks about the ADR market in the USA and Brazil; Activities of the CPR Institute, CPR Resolution, CPR Pledge and CPR International Competition; CPR and its interactions with Brazil. CPR activities: Procedure, Technologies used, number of cases, areas of activity, Services provided, Costs of the procedure, Regulation Clauses.

    Visit to the American Judicial Court in NYC: Understanding and debates on the procedure of the Judicial Courts in relation to the Court-Annexed Courts that carry out Mediation and Arbitration sessions before or during the Trial in the Judiciary, as well as the relationship between the Private Chambers and of ADR with the North American Judiciary.

    Day 4: 05/31 -  09h as 12h –  Exclusive Institucional Visit – UN HQ.

    Topic 13 – Visit to the UN – Exclusive guided tour, in Portuguese (depending on the UN availability) with historical explanations about the creation of the UN and about the building, its architecture that comprises a complex designed by the architectural firm Harrison & Abramovitz, with final projects developed by Oscar Niemeyer and Le Corbusier. In addition we will contemplate the beautiful art pieces donated by several countries, including Brazil. All crowned by the explanation of the current procedure of the UN, its participating Countries and the functioning of its Organs and the visit thereof: United Nations General Assembly: Security Council: Secretariat: Economic and Social Council (ECOSOC); International Court of Justice and the functioning of International Courts; Specialized Programs and Agencies; Commissions and Committees.

    Publication of a Collective Book

    Topic 14 - After the International Immersion proposed at the II NY Mission - CR Connection, all participants will be invited to co-construct an international collective book about topics that reflect the lived experiences and the knowledge achieved to disseminate good practices. A Notice will be provided to organize the Co-creation of the International Collective Book.

    • The dynamics of new times justify the assimilation of different positions. Artificial intelligence, exhaustion of legal channels, the influx of Economic Law lessons (and the respective cost of the process), and the very perception of the reflections of heuristics, noise and biases demand and open up new perspectives. It is in this context that negotiation is inserted, particularly negotiation based on principles, advocated by the Harvard School. A genuine method that seeks to extract the true interests of contenders in its broadest sense, constitutes a modern and effective technique available to litigants to resolve the conflict. Personally, I believe that my participation in the theory and tools on negotiation workshop was of great benefit, as it enabled me to employ optimized techniques for resolving conflicts in the exercise of jurisdiction.
